EU TPD3 & pouch tax: what's coming for 2026–2032
Two EU files — the TPD3 product-rules revision and a proposed minimum pouch excise — could reshape every EU market at once. Here's where they actually stand in August 2026.
Most pouch regulation in Europe is still national, but two EU-level files would change every member state at once. Neither is in force yet — knowing where they actually stand keeps you from over- or under-reacting.
TPD3 — the product rules
The revision of the Tobacco Products Directive (TPD3) is expected to be published by end 2026. It is set to bring tobacco-free pouches into a harmonised framework: standard health warnings, age verification, likely characterising-flavour limits, and eventually EU track & trace. Crucially, the direction is to regulate pouches, not ban them.
The tax file
Separately, the Commission proposed a minimum EU pouch excise of €143/kg or 50% of the retail price, phased toward 2032. That file is stalled: Sweden vetoed the pouch increase, and on 17 June 2026 the European Parliament called on the Commission to withdraw the excise proposal entirely. It needs unanimity in Council and, as of August 2026, has none.
How to prepare
- Design for warnings + track & trace now — leave label real-estate for a standardised warning block and a future 2D code.
- Assume flavour pressure — a tobacco/menthol core line is the safest EU-wide bet.
- Model a higher tax in your EU pricing even though the excise is not law yet.
The single lesson: one EU decision can re-spec or re-price every market you sell in — build the flexibility in before you print, not after.
