Estonia's 2028 nicotine-pouch cap: what brands must do
A draft law would cap Estonian pouches at 4 mg/g and allow only tobacco and menthol flavours from 2028 — a change roughly 80% of today's market would fail. Planning your label now avoids a scramble later.
Estonia's Ministry of Social Affairs and Ministry of Justice have prepared a draft that would, for the first time, put a hard nicotine ceiling on pouches, strips and sprays: 4 mg per gram — down from today's common ~20 mg per pouch. The same draft would restrict permitted flavours to tobacco and menthol only.
Why this matters
By the ministry's own estimate, only about 20% of the products now on the Estonian market would meet the 4 mg/g limit. Roughly 60% would need reformulation and nearly one-fifth would have to leave the shelves. For a brand, that is not a tweak — it is a portfolio decision.
Is it in force yet?
No. As of August 2026 this is a draft, not enacted law, planned to take effect in 2028, with the exact date to be set during legislative review. Nothing changes on your Estonian label today — but the direction of travel is clear, and 2028 is close in packaging-development terms.
What to do now
- Audit your Estonian SKUs against a 4 mg/g equivalent and flag everything above it.
- Plan a tobacco/menthol line for Estonia — fruit and sweet flavours are on the chopping block.
- Keep your artwork modular so a strength and flavour-descriptor change is a text swap, not a re-design.
Estonia is not alone — Latvia already runs a 4 mg/g cap and Denmark caps at 9 mg/pouch with a tobacco/menthol flavour limit, so a compliant "Nordic-strict" label travels further than one built for Estonia alone.
