Austria: nicotine pouches taxed and restricted to tobacconists from April 2026
From 1 April 2026 nicotine pouches fall under Austria's tobacco tax, and the tobacco monopoly restricts sales to licensed tobacconists (Trafiken) — mail-order is prohibited.
What changed — two things at once
Austria's Abgabenänderungsgesetz 2025 (Tax Amendment Act 2025), passed by the Nationalrat on 10 December 2025, makes two significant changes for nicotine pouches:
- Tobacco tax. Nicotine pouches (and e-liquids) are brought under the Tobacco Tax Act (Tabaksteuergesetz), with the tax calculated by mass. Both nicotine-containing and nicotine-free pouches are covered.
- Tobacco monopoly. Pouches are now explicitly inside the tobacco monopoly, so they may only be sold through licensed tobacconists (Trafiken). Mail-order and online sale of these tobacco-related products is prohibited.
When it takes effect
The tax is collected from 1 April 2026, with transitional provisions for products already on shelves. Stock held as of 31 December 2025 may be sold through until 31 December 2026. Further tax increases are already scheduled for February 2027 and 2028.
The sales-channel impact is the big one
The tax raises retail prices (cans are expected around €4.50–6.00 in Trafiken), but the channel restriction is what reshapes the market: if you rely on online or general-retail distribution into Austria, that route is closing. Distribution has to run through the licensed tobacconist network.
What pouch brands should do
- Rethink your Austrian route to market: plan for Trafik distribution; online direct-to-consumer into Austria is no longer permitted for these products.
- Re-price for the tobacco tax from April 2026, and factor in the further 2027/2028 increases.
- Use the transition window: existing stock can move until end-2026 — plan sell-through accordingly.
- Check your label still meets Austria's on-pack requirements — the tax/monopoly change doesn't remove any labelling duty. Run a label check →
